Trademarks

Your name does a lot.

Make sure it's protected.

Forming an LLC or registering a trade name does not tell you whether someone else already has rights in a similar name. A federal trademark registration can protect your name for the goods or services you offer. It starts with a careful look at what is already out there.

Step One

Start with a name check

$199

Order a Name Check

We search federal trademark records, Nebraska business and trade name records, and relevant web and domain use. Within one to two business days, you’ll have a short written summary of what we found and our recommendation.

Each additional name is $99. Hire us to file within 60 days and the $199 is credited toward your application.

A Name Check is a preliminary search, not a guarantee that a name is available. We complete a conflicts check and send a short engagement agreement before we begin.

Step Two

Trademark application

$999

Start Your Application

One name or logo in one class, with the $350 USPTO filing fee included.

Included:

  • A Name Check, if you haven’t had one

  • Review of the owner, mark, filing basis, and goods or services

  • Preparing the application for your review and filing it with the USPTO

  • Tracking your application and its deadlines

  • Routine USPTO correspondence, including minor procedural requests

  • Plain language updates when something changes

Where the package ends

When your mark registers or, for an application filed before use begins, when the USPTO issues a notice of allowance. We’ll tell you the deadline and your options at that point. If the USPTO issues a substantive refusal, responding is outside the package. We’ll explain the issue and quote a fee before you decide.

What could cost more?

  • Additional class of goods or services: $499 each, USPTO fee included
  • Statement of use: $349 per class, USPTO fee included
  • Extension of time to file a statement of use: $225 per class, USPTO fee included
  • Response to a substantive refusal: starting at $750, quoted after we review it
  • USPTO surcharges: confirmed before filing
  • Maintenance filings after registration: quoted when due

No extra work begins without your approval. If a USPTO notice arrives, we’ll tell you what it says and any deadline, even if responding is a separate service. USPTO fees can change and are generally not refundable.

What happens after filing?

The USPTO examines the application and may approve it or raise objections. If approved, the mark is published so others can oppose it. If you filed before using the mark, you’ll need to show use before registration. We track deadlines and handle routine correspondence throughout. No attorney can guarantee that the USPTO will register a mark.

No attorney can guarantee that the USPTO will register a mark.

What we do not handle

Trademark disputes, litigation, opposition or cancellation proceedings, or patents. We can discuss a referral.

Common Questions

I already have an LLC or a trade name. Isn't my name protected?

Not for trademark purposes. Those filings don’t give you a federal registration or tell you whether someone else has rights in the name.

What is a class?

The USPTO groups goods and services into classes and charges a fee for each. We’ll recommend the right ones before filing.

Can I apply before I start using the name?

Yes, in many cases. You’ll need to show use before registration, which involves a separate filing and fee.

What is the difference between ™ and ®?

™ means you claim a mark as your brand. ® is reserved for marks registered with the USPTO.

Can I file an application myself?

Yes. An attorney can help you spot conflicts, choose the right owner and filing basis, and describe your goods or services correctly before you pay the USPTO fee.

What happens after registration?

Keeping a registration requires continued use and later USPTO filings, the first between the fifth and sixth year. Those are not included in the application package.

Ready to look into your name?

Order a Name Check, or book a free 15 minute Discovery Call. The call is not a clearance opinion or a consultation about an existing dispute.

Scheduling a call does not establish an attorney client relationship. Legal work begins only after a conflicts check and a signed engagement agreement. Please do not submit confidential information about a dispute through the website form.
